INTOXICATED SUSPECT CHALLENGES DEPUTY TO FIGHT

Half Moon Bay, California: On Saturday November 12, at 11:45PM deputies were dispatched to 40 Stone Pine Road, in Half Moon Bay regarding a noise complaint.  Prior the Deputy Genaro Urena’s arrival, County Communications advised him that several subjects were standing in front of the above listed address yelling and making noise.  Upon arrival, a crowd of approximately twenty people began to disperse and leave the area.

When the deputy Urena exited his patrol car he contacted an Hispanic male adult, later identified as Luis Aguilar, a Half Moon Bay resident, standing in front of the business.  Aguilar appeared intoxicated. He had red, watery eyes, was unsteady on his feet, slurred speech and Deputy Urena could smell the odor of an alcoholic beverage on his breath when he spoke to him.  Deputy Urena instructed Aguilar to leave the area and to not return.  Aguilar told the deputy he was not going to leave and instead challenged him to a physical fight, saying, "I don't give a *%#! who you is, I'm a norteno from media luna."

Due to his high level of intoxication and his inability to follow simple directions, Aguilar was placed under arrest for PC 647(f)- Public intoxication.  Aguilar was transported and booked into the Maguire Correctional Facility without incident.
